These Terms of Service govern the use of this website and the purchase of products offered through the VSION Artworkonline store.

By accessing this website or placing an order, you agree to these Terms of Service and to the policies referenced herein.

2. Products and Services

VSION Artwork offers physical and digital artwork products, including:

framed artworks;
canvas artworks;
fine art prints where available;
digital artwork files;
personal, commercial and extended commercial digital licences;
other artwork and design products displayed on the website.

Physical artworks may be produced individually after an order is placed and may therefore be described as made to order.

Product specifications, available formats, dimensions, materials and licence conditions are described on the relevant product pages.

3. Product Images and Colours

We make reasonable efforts to display artworks and products as accurately as possible.

However, colours and appearance may vary slightly depending on screen settings, display technology, printing processes, materials and lighting conditions.

Interior images, mockups and lifestyle images are provided for presentation and illustrative purposes. Scale and appearance within mockups may not always represent exact physical proportions.

4. Prices

Prices are displayed on the website in the currency shown at the time of purchase.

The total price payable by the customer, including applicable taxes and any additional charges required by law, will be displayed before the order is completed.

Shipping charges, where applicable, are calculated or displayed during the checkout process.

For international orders, additional customs duties, import taxes or local charges may apply where indicated in our Shipping Policy.

5. Ordering

By placing an order, the customer confirms that:

the information provided during checkout is complete and accurate;
the selected artwork, format, size and licence have been reviewed;
the customer is authorised to use the selected payment method;
the customer agrees to these Terms of Service and the applicable store policies.

After an order is placed, an electronic order confirmation may be sent to the email address provided during checkout.

We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of payment failure, suspected fraud, obvious pricing or technical errors, product unavailability or other circumstances preventing lawful fulfilment.

If an order is cancelled by us after payment has been received, the relevant payment will be refunded.

6. Payment

Payment must be completed using one of the payment methods available at checkout.

Payments are processed through third-party payment service providers integrated with the Shopify platform.

VSION Artwork does not directly store full payment card details where these are processed by third-party payment providers.

7. Physical Artwork Production

Physical artworks are generally produced individually after an order is placed and are made to order.

Estimated production times depend on the selected format:

Framed Artwork — approximately 10 business days
Canvas — approximately 5 business days
Fine Art Print — approximately 5 business days
Framed Fine Art Print — approximately 10 business days

Production times are estimates and may vary depending on artwork format, size, framing requirements, production capacity or other circumstances.

8. Shipping and Delivery

Physical products are shipped to the delivery address provided by the customer.

Shipping times depend on destination, carrier, customs procedures and other delivery conditions.

Estimated shipping or delivery times are not guaranteed unless expressly stated otherwise.

Customers are responsible for providing a complete and accurate delivery address.

9. Returns, Cancellations and Refunds

Returns, cancellations and refunds are handled in accordance with our Return & Refund Policy and applicable consumer protection law.

Certain physical artworks may be made to order or produced according to the customer's selected specifications. Where permitted by applicable law, such products may be excluded from the standard right of withdrawal once production has begun.

This does not affect statutory rights relating to products that are defective, damaged or not as described.

10. Digital Products

Digital artwork files and digital licences are delivered electronically.

The customer is responsible for ensuring that their device, software and printing arrangements are suitable for accessing and using the purchased files.

Digital products do not include ownership of the underlying copyright or intellectual property rights.

11. Immediate Delivery of Digital Content

Where the customer requests immediate access to digital content before the end of the applicable withdrawal period, the customer may be required to:

expressly consent to immediate performance; and
acknowledge that the right of withdrawal may be lost once delivery or downloading of the digital content has begun.

This applies in accordance with applicable consumer protection legislation.

12. Digital Licences and Intellectual Property

All artworks, images, designs, digital files, text and other creative materials available through VSION Artwork are protected by copyright and other applicable intellectual property laws.

Purchase of a digital artwork grants only the licence specified for the selected purchase option.

Depending on the product, this may include:

Personal Use Licence;
Commercial Use Licence;
Extended Commercial Licence.

The specific permissions and restrictions applicable to each licence are set out in the relevant product information and licence documentation supplied with the purchase.

Unless expressly permitted by the applicable licence, customers may not reproduce, redistribute, sublicense, resell, share, publish, modify or commercially exploit digital artwork files.

No copyright or ownership rights are transferred to the customer unless expressly stated in writing.

13. Physical Artwork Copyright

Purchase of a physical artwork transfers ownership of the purchased physical object only.

Copyright and other intellectual property rights relating to the artwork remain with VSION Artwork or the relevant rights holder unless expressly agreed otherwise in writing.

Purchasing a physical artwork does not grant the customer the right to reproduce, manufacture, distribute or commercially exploit the artwork.

14. Website Use

You may use this website only for lawful purposes.

You must not:

attempt to gain unauthorised access to the website or its systems;
interfere with website security or operation;
use automated systems to improperly extract website content;
reproduce or commercially exploit website content without permission;
use the website for fraudulent or unlawful activities.

15. Availability and Technical Issues

We aim to keep the website and digital delivery systems available and functioning correctly.

However, uninterrupted or error-free access cannot be guaranteed.

Temporary interruptions may occur due to maintenance, technical failures, third-party services or circumstances beyond our reasonable control.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation would be prohibited by applicable law.

To the extent permitted by law, VSION Artwork is not responsible for indirect or consequential losses that were not reasonably foreseeable at the time of purchase.

Nothing in these Terms limits mandatory consumer rights.

17. Third-Party Services

The website may use or link to third-party services, including payment providers, shipping providers and other technology services.

The use of third-party services may also be subject to the terms and privacy policies of those providers.

18. Changes to These Terms

We may update these Terms of Service where reasonably necessary, including to reflect changes in our products, services, website operation or applicable law.

Changes will apply from the date the updated Terms are published and will not retroactively alter rights and obligations arising from orders already concluded, unless required by law.

19. Severability

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will remain in effect to the extent permitted by law.
